Only altruistic surrogacy is legal in India
Under the Surrogacy (Regulation) Act, 2021, surrogacy is allowed only for eligible intending couples or women with a medical need, at a registered clinic, with government certificates. Be wary of anyone offering a quick route outside this process. VinsHealth gives information and medical consultation; it does not arrange surrogates.
🤲 About Surrogacy

What Is Gestational Surrogacy?

In gestational surrogacy, an embryo created through IVF is placed in the uterus of another woman, the surrogate mother, who carries the pregnancy and gives birth. The surrogate is not genetically related to the baby. In India, this is the only form of surrogacy allowed, and it must be altruistic.

Most people begin by searching “surrogacy centre near me” or “surrogacy cost in India”, and quickly find conflicting information. The rules changed with the Surrogacy (Regulation) Act, 2021, the 2022 Rules and the 2024 amendment, and courts have clarified parts of them since. A consultation helps you understand where you stand before you spend money.

Surrogacy is a medical decision first. It is meant for couples or women who cannot safely carry a pregnancy themselves. In the consultation, a specialist looks at your medical history and reports, explains whether a District Medical Board is likely to certify the need, and walks you through the legal steps, the timeline and realistic costs.

🤔 Is Surrogacy Right for You?

IVF, Surrogacy or Adoption?

These paths suit different situations. A specialist can help you see which one fits yours.

IVF With Your Own Uterus
If the woman can safely carry a pregnancy, IVF (with your own or donor gametes as allowed) is usually tried first. Surrogacy is not permitted just for convenience.
Gestational Surrogacy
For a certified medical reason, such as no uterus, a damaged uterus, repeated IVF failure or a condition that makes pregnancy dangerous.
Adoption
A legal route to parenthood through CARA (Central Adoption Resource Authority). Some couples consider it alongside or instead of treatment.
📚 10 Things to Understand

Surrogacy in India,
Step by Step

Each section covers one part of the law or the process in plain language. Rules can change, so your specialist will confirm the current position for your case.

Section 02 of 10

Who Can Opt for Surrogacy: Married Couples

An intending couple must be a legally married Indian man and woman. On the day of certification, the wife must be between 23 and 50 years and the husband between 26 and 55. The couple should not have a surviving child, whether biological, adopted or through surrogacy.

Eligibility at a Glance
Legally married man and woman
Wife 23–50, husband 26–55 years
No surviving child (with exceptions)
Certified medical need
NRI and OCI couples are covered
Good to Know
There is an exception for couples whose child has a serious physical or mental disability or a life-threatening illness with no permanent cure, with approval from the authorities. In October 2025 the Supreme Court held that the age limits do not apply to couples who had started the process and frozen embryos before the Act came into force.
Section 03 of 10

Widowed or Divorced Women

A widowed or divorced woman aged 35 to 45 can opt for surrogacy if she has a medical need. Under the 2024 amendment to the Rules, she must use her own eggs with donor sperm. Never-married women are not currently included under the Act, and this has been challenged in court.

Key Points
Age 35 to 45 years
Widowed or divorced
Own eggs with donor sperm
Same certificates as couples
Counselling is mandatory
Good to Know
If a woman’s own eggs are unlikely to work, surrogacy may not be possible under the current rules. A specialist can assess egg reserve first with AMH and scan results.
Section 04 of 10

Medical Reasons for Surrogacy

Surrogacy is meant for situations where the woman cannot carry a pregnancy, or where pregnancy would put her life or health at serious risk. The District Medical Board examines the reports and decides whether the medical indication is met.

Common Indications
No uterus from birth (e.g. MRKH) or after hysterectomy
Severely scarred or damaged uterus (e.g. Asherman’s)
Repeated IVF failure despite good embryos
Repeated miscarriages from a uterine cause
Serious heart, kidney or other illness that makes pregnancy unsafe
Good to Know
Bring all your reports: scans, hysteroscopy, IVF summaries and specialist letters. Clear documentation makes the medical board process smoother.
Section 05 of 10

Who Can Be a Surrogate Mother

The law sets clear criteria for the surrogate. She must be a married woman (or one who has been married) between 25 and 35 years of age, with a child of her own. She can act as a surrogate only once in her lifetime, must be medically and psychologically fit, and cannot provide her own eggs.

Surrogate Criteria
Age 25 to 35 years
Ever married, with her own child
Once in her lifetime
Medical and psychological fitness certificate
Not genetically related to the baby
Good to Know
The surrogate gives informed written consent, has the right to withdraw before the embryo is placed, and must be covered by insurance for 36 months taken out by the intending couple or woman.
Section 06 of 10

Donor Eggs or Sperm in Surrogacy

Since the February 2024 amendment, a couple may use a donor egg or donor sperm if the District Medical Board certifies that the husband or wife has a medical condition that requires it. At least one gamete must still come from the intending couple, so the baby is genetically related to at least one parent.

Key Points
Allowed only with medical board certification
One gamete must be from the couple
Donor eggs or donor sperm, not both
Single women: own eggs plus donor sperm
Donors come only through registered ART banks
Good to Know
If neither partner can provide a gamete, surrogacy is not currently possible under the Rules. A specialist can talk you through the alternatives, including adoption.
Section 08 of 10

NRI & OCI Couples

Indian couples living abroad and Overseas Citizens of India (OCI) are covered by the same eligibility rules as couples living in India. Foreign nationals without OCI status cannot opt for surrogacy in India.

Plan Ahead For
Passport and OCI or NRI documents
Attested marriage and medical records
Time in India for medical steps
Certificates from the Appropriate Authority
The baby’s travel documents after birth
Good to Know
An online consultation is a practical first step from abroad: you can check eligibility and gather the right reports before planning your trip.
Section 09 of 10

How Long Surrogacy Takes

From the first consultation to the birth, surrogacy usually takes well over a year. Medical tests and IVF to create embryos come first, along with the medical board and certificates, then the embryo transfer to the surrogate and a full-term pregnancy.

Typical Stages
Consultation and tests
Medical board and certificates
IVF and embryo freezing
Embryo transfer to the surrogate
Pregnancy and delivery
Parentage order and birth certificate
Good to Know
Under the Rules, the surrogacy procedure can be attempted on a surrogate no more than three times, and usually one embryo is transferred at a time.
Section 10 of 10

Emotional Support & Alternatives

The road to surrogacy often follows years of trying, failed treatment or loss. It is normal to feel exhausted, anxious or unsure. Counselling is part of the legal process, and talking to someone can also help you and your partner make decisions together.

Support That Can Help
Counselling before treatment
Talking through IVF with your own uterus first
Exploring adoption through CARA
Support for the couple’s relationship
Planning finances realistically
Good to Know
There is no right or wrong path to parenthood. A specialist can explain the medical side, and a psychologist can help with the emotional side.
